Terms of Service
Effective [EFFECTIVE DATE]
These terms are an agreement between you and [ENTITY NAME], [ADDRESS] ("Local Pinmeter", "we"). They cover the website localpinmeter.com, the app and everything in it (the "service"). By creating an account or using the service you agree to them. If you sign up for a company, you confirm you can bind it, and "you" means the company.
These also apply and are part of the terms:
- the Acceptable Use Policy;
- the Data Processing Agreement, for data you put in about your clients and leads.
The Privacy Policy explains how we handle personal data.
1. The service
Local Pinmeter is a geo-grid rank tracker. It shows where a business ranks in Google Maps results at points on a map around it, and turns that into reports for agencies and their clients.
- Results are a measurement, not a promise. Each point shows what Google returned for that search, at that place and time, through our data provider. Google's results change and differ by device and person. We don't guarantee any ranking, and we don't guarantee results will match another tool's.
- We are not affiliated with Google or with any other rank tracker. Where another company's service is mentioned, it is only to describe an import or a connection.
- The service is for business use. You must be 18 or older.
2. Your account
- One workspace per agency. Invite as many team members as you like. You're responsible for what they do in your workspace.
- Keep your password safe. Tell us at once through the feedback form if you think someone else got into your account.
- The information you give us when you sign up must be true and kept up to date.
3. Plans and credits
A credit is one grid point for one keyword. A 7×7 grid uses 49 credits, and a 13×13 grid uses 169.
- Google Maps results, on a phone (top 20) or a computer (top 100), use 1 credit per point.
- Local Pack and Local Finder results use 2 credits per point.
- The app shows the credits a scan will use before it starts. A scan starts only if your balance covers it.
- A point that returns no result because of an error on our side or our data provider's gives its credit back. A point where your business isn't in the results is a result, and its credit is used.
Monthly credits. Each plan gives a set number of credits every billing month. They are shown on the pricing page and in the app.
- Unused monthly credits roll over for 2 months, then expire.
- Credits are used oldest first: rolled-over credits, then this month's, then extra credits.
Extra credits can be bought in the app at the price shown there. They last 180 days from purchase.
No automatic recharge. We never buy credits for you.
- At 80% used, we warn you in the app and by email.
- At zero, new and scheduled scans pause. The app says why and offers a top-up.
Credits have no cash value. You can't transfer or sell them, and they aren't refunded except as section 6 says.
Unlimited clients, keywords and team members. Every plan has them. Plans differ only in credits.
4. Free trial
- New agencies get 1,000 free credits with no card. They expire 30 days after sign-up.
- One trial per agency. Trials are also limited per email domain and per connection.
- Scheduled scans need a paid plan.
- When the trial ends, your data stays. Pick a plan to keep scanning.
5. Billing
- Plans are paid in advance, monthly or yearly, by card through Stripe. We never see or store your full card number.
- Prices exclude taxes. Sales tax or VAT is added where the law requires it.
- Price changes. We tell you at least 30 days before a new price applies to your next renewal.
- If a payment fails, scheduled scans pause and we email you. After 14 days unpaid, the workspace becomes read-only until the invoice is paid.
6. Changing plans, cancelling and refunds
Change or cancel yourself in the app's Billing page (Stripe's billing portal). No call and no email needed.
- Upgrades apply at once. You pay the difference for the rest of the period, and the new credits are added.
- Downgrades apply at your next renewal.
- Cancelling stops the next renewal. You keep access and your credits until the end of the period you paid for.
Refunds. Payments aren't refunded for part of a period. There are two exceptions:
- A billing mistake on our side: we refund it in full.
- A first-ever paid month or year cancelled within 7 days of payment, with less than 10% of its credits used: we refund it in full.
7. Your data
- You own your data: projects, keywords, scan results, reports, branding, client packages and leads. We use it only to run the service for you, as the Data Processing Agreement says.
- Export any time as CSV or JSON from the app.
- Share your reports. You may share your reports, share links, PDFs, exports and screenshots of your own results with your clients and prospects, under your own brand. Reports keep a small "Powered by Local Pinmeter" line; don't remove or hide it.
- After you cancel or close your workspace, we keep your data 90 days so you can come back or export it. Then we delete it. Backups roll off within 30 days after that.
- You are responsible for having the right to track the businesses you add and to contact the leads your lead pages collect. You're also responsible for any tracking tags you add to your lead pages.
- Feedback you send us can be used to improve the service, with no duty to you.
8. Connected services
- Google Business Profile. If you connect a Google account to publish posts, you authorise us to act on the profiles you choose. Google's terms also apply. You can disconnect in the app, or in your Google account, at any time.
- Imports from other rank trackers. You confirm the data is yours to import and that the other tool's terms allow it. An API key you give us for another tool is used for that import only and isn't stored.
- We aren't responsible for these services, their changes or their outages.
9. Our service and trademarks
- We own the service: the software, screens, report layouts, the Pinmeter Score method, the help pages and the website, and everything we build on them. These terms give you a limited right to use the service for your business while your account is active. You can't sell, sublicense or transfer that right.
- "Local Pinmeter", "Pinmeter Score", our logo and our tagline are our trademarks. You may say that you use Local Pinmeter. Don't use our name or logo in a way that suggests we endorse you, or in your own product, company or domain names. Putting your agency's brand on reports is fine; that's what they're for. Every report also carries a small "Powered by Local Pinmeter" line, which stays.
- Don't copy the service: don't copy, frame or mirror it, or copy its screens, report layouts or workflows into another product.
- Your feedback may be used to improve the service, as section 7 says.
10. Competitors
- If you make, sell or work for a product that competes with Local Pinmeter, you may not use the service, including the free trial and the free scan, without our written permission. That includes using it to analyse, benchmark or copy the service, or to build or improve a competing product.
- Competitors may not publish comparisons of the service with their own product, such as rankings, speed or accuracy, based on use of the service, without our written permission.
- Agencies comparing tools for their own choice may compare Local Pinmeter with any other tool, and may share what they find with their own clients.
- We may refuse, pause or close a competitor's account at any time, without refund for credits used in breach of this section.
11. Features in testing
- Features marked "beta", "preview" or "coming soon" may change or be removed and are provided as they are, without the commitments in section 12.
- API. If we offer an API, its documentation and rate limits apply as part of these terms. API keys belong to your workspace. Keep them secret and don't share them outside your team.
12. Availability and changes
- We aim to keep the service running but don't promise it will always be available or error-free. Outages and maintenance are posted on the status page.
- We may change features. If we remove a major feature you pay for, we tell you at least 30 days ahead. You may then cancel and get a refund for the unused part of a yearly plan.
13. Suspension and termination
- You can close your workspace at any time in the app.
- We may pause or close an account that breaks these terms or the Acceptable Use Policy, or that puts the service or others at risk.
- We warn you first when we reasonably can.
- Credits used in breach of the terms aren't refunded.
14. Disclaimers and liability
- The service is provided "as is". To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
- Neither side is liable to the other for indirect or consequential losses, or for lost profits, revenue or data, even if warned. To the extent the law allows, our total liability under these terms is limited to the fees you paid us in the 12 months before the claim.
- You will defend us against claims that arise from your content or from breaking these terms or the law, and cover the costs of those claims.
15. General
- Changes to these terms. We tell you by email and in the app at least 30 days before material changes take effect. If you keep using the service after that, you accept them.
- Disputes. Before starting a claim, either side first tries to settle it in good faith for 30 days after a written notice that describes it.
- Law and courts. The laws of
[STATE]govern these terms, and its courts decide disputes. - Publicity. We won't name your agency as a customer, show your logo, or quote you without your permission.
- Events outside our control, such as outages at Google, our data provider or our host, or natural disasters, excuse delays they cause, for as long as they last.
- Transfer. You can't transfer these terms without our written consent. We may transfer them to a company that takes over the service, and we'll tell you if we do.
- No waiver. If we don't enforce a term straight away, we can still enforce it later.
- Notices. We send notices to your account email. Formal legal notices to us go to
[LEGAL EMAIL]. - Help is self-service: the help pages, the status page, and the feedback form in the app.
- If part of these terms can't be enforced, the rest still applies. These terms, with the documents they link to, are the whole agreement between us about the service.
